About these terms

These terms of use apply to the website uptechture.com and its tools, such as our forms, the project cost estimator and the free website audit (together, “the site”). The site is run by UPTECHTURE (“we”, “us”, “our”).

By using the site, you accept these terms. If you do not agree with them, please do not use the site.

Using the site

The site is meant for businesses and professionals who want to learn about our services and contact us about a project. You may browse the site, share links to its pages and use our forms and tools for that purpose.

Please give accurate details when you use our forms, so we can reply to you properly.

Information on the site

The content of the site is general information about our services and about software, websites and technology. It is not advice for your specific situation, and we do not guarantee that it is complete or always up to date.

Results from the project cost estimator are indicative ranges based on your answers. They are not a quote or an offer. Results from the free website audit are an automated snapshot of public data at the time of the check, and they are also indicative.

A binding price, scope and timeline are only agreed in a written proposal or contract.

Our intellectual property

The site and its content, including text, graphics, illustrations, the logo, design and code, belong to UPTECHTURE or to our licensors. They are protected by copyright and other laws.

You may view the site and print or save pages for your own use. You may not copy, republish, sell or otherwise use our content commercially without our written permission. Please do not use the UPTECHTURE name or logo in a way that suggests we endorse you or work with you, unless we have agreed this in writing.

Things you send us

When you send us information or files through our forms, by email or via WhatsApp, you confirm that you have the right to share them with us, and that sharing them does not break any law or agreement, such as a confidentiality agreement with someone else.

We treat what you send us as confidential. We use it only to reply to you and to prepare a proposal. We do not publish it, and we share it only with the service providers we need to handle your enquiry (see our Privacy policy). You keep all rights to the materials you send us.

Please do not send passwords, access details or payment details through the site. If a project later needs access to one of your systems, we will agree a secure way to share it.

Acceptable use

When you use the site, you must not:

• break any law, or use the site to commit fraud or to harm others;
• upload or send malware, viruses or any other harmful code;
• try to gain unauthorised access to the site, our servers, our database or other systems, or test their security without our written permission;
• scrape, crawl or copy the site or its content in bulk with automated tools, other than normal indexing by search engines;
• misuse the free website audit, for example by sending large numbers of requests, using it to overload or attack a website, or trying to reach private or internal network addresses through it;
• send spam, or use our forms to send content that is unlawful, abusive or misleading;
• get around our protection against spam and abuse, such as rate limits or bot checks.

We may block access, limit requests or remove content if we believe these terms are being broken.

Availability of the site

We work to keep the site available and correct, but we do not promise that it will always be available or free of errors. We may change, suspend or remove any part of the site, including the estimator and the audit, at any time.

Links to other websites

The site may link to websites of other companies, such as LinkedIn or WhatsApp. We do not control those websites and are not responsible for their content, products or privacy practices. A link does not mean that we endorse them.

Our liability

We provide the site and its free tools “as is”, without any promise about results. As far as the law allows, we are not liable for loss or damage caused by using the site, by relying on its content, estimator ranges or audit results, or by the site being unavailable. This includes indirect loss, such as lost profit, lost data or lost business.

Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, for example liability for fraud, or for death or personal injury caused by negligence. It also does not affect any rights you have under mandatory consumer law.

Project work

These terms cover the website only. Any work we do for you, such as design, development, support or maintenance, is governed by a separate written agreement between you and UPTECHTURE. If that agreement and these terms differ, the agreement applies to the project work.

Changes to these terms

We may change these terms from time to time, for example when we add new features to the site. The date on this page shows when they were last updated. The version published when you use the site applies.

Governing law

These terms are governed by the laws of Bangladesh. The site is aimed at business users. If you use the site as a consumer, this does not take away the protection that the mandatory consumer laws of your country give you.

If any part of these terms is found to be invalid, the rest of the terms stays in force.
